Please read these Terms of Service carefully before using the Trackowheels platform. By accessing or using our Service, you agree to be bound by these Terms.
By accessing or using the Trackowheels platform, mobile application, or any related services (collectively, the "Service") provided by Wideangle Technologies Private Limited ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms apply to all users, including fleet operators, individual users, and any organisation accessing the Service on behalf of its employees or clients.
Trackowheels provides a fleet management platform that includes real-time GPS tracking, fuel monitoring, driver behaviour analysis, AI-powered dashcam integration, alert management, and analytics reporting ("Service").
The Service is offered on a subscription basis. Features available to you depend on the plan you have subscribed to. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
To use the Service, you must create an account by providing accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You must notify us immediately at support@trackowheels.com if you suspect any unauthorised access to your account. We are not liable for losses caused by unauthorised use of your account.
You must be at least 18 years of age and have the legal authority to enter into these Terms on behalf of yourself or your organisation.
Subscriptions are billed in advance on a monthly or annual basis depending on the plan selected. All fees are non-refundable except as expressly stated in our refund policy or required by applicable law.
We reserve the right to change pricing with 30 days' written notice. Continued use of the Service after the effective date of a price change constitutes your acceptance of the new pricing.
Failure to pay subscription fees may result in suspension or termination of your account. All outstanding amounts remain due even after account termination.
Certain plans include GPS tracking devices, fuel sensors, or dashcams ("Devices"). Devices remain the property of Wideangle Technologies Private Limited unless explicitly sold to you under a separate purchase agreement.
You are responsible for the proper use and safekeeping of all Devices installed in your vehicles. Damage caused by misuse, tampering, or neglect is not covered under warranty and will be charged to you.
Upon termination of your subscription, you must return all Company-owned Devices in working condition within 14 days. Failure to return Devices may result in charges equivalent to the replacement cost.
You retain ownership of all fleet data generated through your use of the Service ("Customer Data"). By using the Service, you grant us a limited licence to process Customer Data solely to provide and improve the Service.
We will not sell your Customer Data to third parties. We may use aggregated and anonymised data for product analytics and improvement purposes.
Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy at trackowheels.com/privacy-policy.
You agree not to use the Service to: (a) violate any applicable laws or regulations; (b) infringe on the intellectual property rights of any third party; (c) transmit malicious code or interfere with the Service's infrastructure; (d) attempt to gain unauthorised access to any part of the Service or its related systems; (e) use the Service to track individuals without their knowledge or legal authority to do so.
You are solely responsible for ensuring that your use of the Service — including vehicle and driver tracking — complies with all applicable employment, privacy, and data protection laws in your jurisdiction.
The Service, including all software, algorithms, interfaces, content, and branding, is the exclusive property of Wideangle Technologies Private Limited and is protected by applicable intellectual property laws.
These Terms do not grant you any ownership rights in the Service. You may not copy, modify, distribute, reverse-engineer, or create derivative works based on the Service without our express written consent.
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
Our total aggregate liability to you for any claims under these Terms shall not exceed the total amount paid by you to us in the 12 months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to fitness for a particular purpose or uninterrupted availability.
You may terminate your account at any time by contacting us at support@trackowheels.com. Termination does not entitle you to a refund of any prepaid fees.
We may terminate or suspend your account immediately, without prior notice, if you breach any provision of these Terms, fail to pay subscription fees, or if we are required to do so by law.
Upon termination, your right to access the Service ceases immediately. We will retain your Customer Data for 30 days post-termination, after which it may be deleted.
These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India.
Before initiating any legal action, the parties agree to attempt to resolve disputes amicably through good-faith negotiation for a period of 30 days.
We reserve the right to update these Terms at any time. We will notify you of material changes via email or a prominent notice on the platform at least 14 days before the changes take effect.
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the revised Terms.
